1. Acceptance of Terms

By accessing or using TouchSuite's website, products, or payment processing services (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use our Services. These Terms apply to all users, including merchants, partners, and visitors.

2. Services Description

TouchSuite (American Bancard, LLC d/b/a TouchSuite®) provides merchant payment processing services including, but not limited to:

• Credit and debit card processing
• Point-of-sale system deployment and support
• Payment gateway integration services
• General ledger sync and reconciliation tools
• Fraud prevention and chargeback management tools

3. Merchant Obligations

Merchants using our Services agree to:

• Provide accurate and complete information during the application and onboarding process
• Comply with all applicable card network rules (Visa, Mastercard, Amex, Discover)
• Maintain PCI DSS compliance for their business operations
• Not use the Services for prohibited or illegal transactions
• Promptly respond to chargeback notices and provide requested documentation

4. Fees and Payments

Processing fees, monthly fees, and any applicable charges are outlined in your Merchant Agreement. TouchSuite reserves the right to adjust fees with 30 days' written notice. All fees are non-refundable except as expressly stated. Merchants are responsible for all fees associated with disputed transactions and chargebacks.

5. Limitation of Liability

To the maximum extent permitted by applicable law, TouchSuite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Services. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Palm Beach County, Florida.
